A Missouri appeals court will not hear a man's case regarding the dismissal of his affidavit claiming Ferguson officer Darren Wilson assaulted Michael Brown before fatally shooting him.
The Missouri Court of Appeals' Eastern District dismissed CleveMolette's case today, where Molette claimed a lower court wrongly threw out his affidavit.
Molette claimed Wilson grabbed Brown's shirt and hit Brown's friend with his vehicle door before fatally shooting Brown in August 2014. A grand jury chose to not indict Wilson.
Molette said the St. Louis Circuit Court violated his rights by dismissing his affidavit without a hearing.
However, the appeals court panel said only prosecutors and grand juries can decide whether to prosecute, and not individual citizens such as Molette.
According to online court records, Molette lives in Forest Park, Georgia and does not have an attorney.
