Lawyers for a Missouri man have filed a late appeal with the U.S. Supreme Court alleging there were racial bias and constitutional errors at his trial.

Williams is scheduled to be executed Tuesday for the 1998 killing of Felicia Gayle. His attorneys have launched multiple legal battles in an attempt to save his life.

Matthew Jacober, special counsel for St. Louis County Prosecuting Attorney Wesley Bell’s office, filed the appeal earlier this week with the state’s high court, asking it to review St. Louis County Judge Bruce Hilton’s ruling upholding Williams’ conviction.

On Wednesday, a St. Louis County Circuit Judge presided over an evidentiary hearing challenging Marcellus Williams’ guilt. He is expected to announce a ruling by mid-September.
